Nine individuals, including employees from NVIDIA and Super Micro, have been indicted for illegally exporting advanced AI servers to China. The alleged scheme involved collusion across multiple levels of these companies, all driven by what prosecutors described as “enormous profit” motives.

The timing is particularly interesting given that the US has recently loosened its export restrictions on NVIDIA chips to China. You’d think that would reduce the incentive for illegal exports, but apparently not. The defendants allegedly operated with full knowledge of NVIDIA and Super Micro’s “rigorous” export control procedures, yet went ahead anyway. Prosecutors from Keelung said the conspiracy “severely damaged our nation’s international image,” which speaks to how seriously Taiwan takes its role in the global semiconductor supply chain.

The Geography of a Chip Supply Chain

Here’s where it gets complicated. NVIDIA is an American company, but it’s fundamentally dependent on Taiwan for manufacturing and packaging. Most NVIDIA chips flow through Taiwan Semiconductor Manufacturing Company, or TSMC, which dominates global chip production. The company’s latest Blackwell AI chips get manufactured in Phoenix, Arizona, but then ship back to Taiwan for advanced packaging before final assembly. It’s a bizarre geographic dance that highlights how fragmented semiconductor production really is.

Taiwan sits at the chokepoint of the global tech supply chain, and the government knows it. That’s why they’re ultra-strict about what leaves their shores, particularly newer technology. They’re acutely aware that upsetting US regulators, especially under the Trump administration, could have serious consequences for their semiconductor ecosystem. So when people try to circumvent these controls, Taiwan treats it as a national security issue, not just a corporate compliance problem.

The Smuggling Methods Keep Evolving

But here’s the frustrating part for regulators: bad actors keep finding new routes. In one documented case, approximately $1 billion worth of server racks allegedly made their way to China through Southeast Asian countries like Thailand and Malaysia. That’s not a small operation. It’s a coordinated effort to use third-party nations as transshipment points, exploiting the complexity of global logistics networks.

Then there’s the case where the US charged three people with exporting $3.5 billion worth of AI servers to China using similar routing tactics. That number is staggering. When you can move that much hardware through third-party countries without detection, it suggests the smuggling networks are sophisticated and well-funded.

The US has maintained its ban on cutting-edge AI technology exports to China since 2022. Recently, they’ve made concessions by allowing sales of previous-generation products like H200 chips that are several years old. It’s a calculated middle ground that allows some commerce while supposedly protecting national security. Yet the indictments suggest that even this compromise isn’t stopping determined smugglers.

What makes these cases particularly telling is that they involve employees at major companies, not just independent operators. When people working inside NVIDIA and Super Micro allegedly participate in illegal exports, it raises uncomfortable questions about internal controls and corporate culture. How do you build export compliance procedures that actually work when your own employees are the ones circumventing them?

The answer, apparently, is that you don’t. Not completely anyway. The Taiwan case shows that the global semiconductor supply chain remains vulnerable to exploitation, regardless of how many rules are written or how strictly they’re supposedly enforced. As long as the profit margins on AI chips remain astronomical, there will be people willing to take the risks.
